These terms and conditions of use are a legal contract between you and BIO PROVENCE S.A.R.L.. By using this website, you accept the terms of use. Otherwise, do not use this website. www.boutique-pulpedevie.fr distributes organic cosmetics and products.

 

These terms of use apply to all orders made on the website www.boutique-pulpedevie.fr.

 

At any time BIO PROVENCE S.A.R.L reserves the right to adjust or modify these terms of use. In case of modification, the general conditions in place on the day of the order will be applied.

1 - Terms of use : Agreement and application

The buyer acknowledges the terms of use that are clearly stated by BIO PROVENCE S.A.R.L on its website: www.boutique-pulpedevie.fr and accepts them without reservation at the time of purchase. These terms of use prevail over all other conditions contained in any document, except for prior exemption, expressed or written. The seller is defined below as the company BIO PROVENCE S.A.R.L via www.boutique-pulpedevie.fr, with headquarters located at rue Fréderic Joliot Curie No. 45, BP 100, 13382 MARSEILLE Cedex 13 - Phone +33 4 91 11 88 85.

 

BIO PROVENCE S.A.R.L is registered at the Registre du Commerce et des sociétés de Marseille under the Siren number 519 105 019 and the buyer is defined below as being the company or person signing and accepting these terms and conditions. The buyer claims to have the capacity to contract the terms described below, that he is of legal age and not under guardianship. Before making his order, the buyer acknowledges these Terms of Use.

 

Each product ordered on this website requires consultation and expressed agreement with these Terms of use, without necessity of the user's handwritten signature. In accordance with the Civil Code articles 1316 to 1316-4, completed by the Decree n° 2001-272 of the 30th March, 2001, taken for the purposes of the Civil Code section 1316-4 about electronic signature, it is reminded that the validation of the order, as specified in the article 2, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.

2 - The Order

The automatic registration systems via Internet are considered as proof of the nature, of the content and date of the order. In case of ordering via Internet, BIO PROVENCE S.A.R.L confirms the acceptance of the client's order via the email address given by the client.

 

After examining the status of the order, and once the buyer has given all the information required, the buyer will validate the order and proceed to payment. The buyer can choose the payment method of his preference, providing that he has the means to pay this way.

 

The sale will not be considered final until BIO PROVENCE S.A.R.L has sent him a confirmation of his order via www.boutique-pulpedevie.fr and received the full amount of payment. BIO PROVENCE S.A.R.L recommends the buyer to keep this information on paper or computer. BIO PROVENCE S.A.R.L reserves the right to cancel any order from a customer with whom there is a dispute over a totally or partially unpaid previous order payment.

3 - Price

All the prices are in Euros, taxes included (T.V.A), the delivery remains the responsibility of the buyer if the amount of his invoice does not equal entitlement to free shipping. The prices can be found in the electronic catalog on www.boutique-pulpedevie.fr.

 

BIO PROVENCE S.A.R.L reserves the right to modify the prices and services at all times, the charged products correspond to the prices in place on the day of the order given by www.boutique-pulpedevie.fr . The products remain the property of BIO PROVENCE S.A.R.L until the total amount of the order is completely payed. The prices are charged in Euros. The transactions are always made in Euros. The price on each product does not include the shipping fee.

 

The price shown in the order's confirmation is the definitive price. Plus the TVA, postage and packing.

4 - Availability of ordered products

BIO PROVENCE S.A.R.L will send an email to the buyer in case of temporary unavailability of a product. The buyer will then have a working week (excluding holidays and weekends) to cancel or change his order by getting in contact with our customer service at myabeille@pulpedevie.fr. BIO PROVENCE S.A.R.L reserves one-week extension to process the order. If a product is definitely unavailable after the order, the buyer will be informed which articles are unavailable via e-mail or telephone.

 

If no request from the buyer was found after this period, the order will be shipped with the available products and only these will be charged.

The products are offered according to their availability. In case of unavailability of one of these, the buyer will be informed when viewing the product on the website. This information could be notified, wherever possible, as shown below:

While establishing the order ; following the validation of the order, before shipping, via e-mail.

 

BIO PROVENCE S.A.R.L will then arrange with the Banque Populaire to subtract the price of the unavailable products from the total amount that has been charged, if the payment was done by credit card it will be refunded to the buyer's bank account.

 

In case of payment by check, BIO PROVENCE S.A.R.L will refund the overpayment with a check.

5 - Delivery

BIO PROVENCE S.A.R.L. will deliver the order to the address given by the buyer during his order. If the buyer gives a wrong or incomplete address, he will be responsible if the packet can not be shipped. If your package is returned to us because of a wrong or incomplete address, the shipping will be your responsibility regardless to the amount of your order and will be charged to your account according to the shipping fee of your country code.

 

Any shipping delay does not entitle the buyer to claim compensation for damages. The buyer must make sure that the products are in good state at the moment of reception, if there is any problem, he should refuse to receive the order and give it back to the delivery person. BIO PROVENCE S.A.R.L is released from its obligation to deliver your order in case of: wars, riots, fires, strikes, or accidents.

 

The products are shipped under the recipient's responsibility of risks and dangers. Always check your package when receiving it. If you have any doubt about the state of your package, refuse to receive it, if not, BIO PROVENCE S.A.R.L will not refund your order.

Duration of shipping between the client's order and its products delivery depends on the payment method chosen by the client.

 

For reasons of order processing and availability of the products (out of stock, production halt, etc.) an order may be shipped to the client in several packages, in that case only the first delivery will be charged.

For your information, our service all around metropolitan France is done by La Poste in 48 hours. Any delay in shipping can not give the right to compensation or cancellation of the order by the buyer.

 

In any case, and in accordance with the article L. 121-20-3 of the consumer code, the ordered products will be delivered within 30 days maximum starting the day after the buyer made his order, under reserve of full payment of the price of the product.

 

The lack of delivery at the end of this period gives the buyer the possibility to cancel his order. The amount payed will be refunded immediately, excluding any other compensation. In case of a delay, the buyer will have to notify BIO PROVENCE S.A.R.L through a written document (mail, email) to allow improvement of the service provided to him and allowing BIO PROVENCE S.A.R.L to conduct a survey of the carrier.

 

All the orders delivered outside of Metropolitan France and Corsica will be carried by the services of FEDEX. Delivery leadtime will depend on the delivery address communicated by the buyer when placing the order.  The company BIO PROVENCE S.A.R.L will not cover any custom duties  related to orders delivered outside of the European Union. Freight charges communicated and paid on our website do not include potential customs duties that might need to be paid at the delivery by the buyer.

6 - Delivery problems due to carrier

Any anomaly concerning the delivery (missing item checked in the delivery document, damaged package, broken products, …) will have to be indicated on the delivery form « Handwritten reserves », next to the client's signature. In addition to this, the client will have to confirm this anomaly with the carrier within the next two (2) working days after the delivery, giving him a mail with return receipt stating his claims. All our orders are delivered by La Poste. This service delivers in 48 hours in all of metropolitan France and gives you the possibility to pick up your package at the nearest post office in case of absence at the initial address given by the client. If you were absent on the day of delivery, you will receive a notification in your mail box, that will allow you to pick up your package at the post office during the opening hours, within the next 15 days. If your package was not picked up within these 15 days, the forwarding delivery amount of your order will be charged to your account according to the shipping fee of your country code.

 

BIO PROVENCE S.A.R.L will not be held responsible for the delays and losses of La Postes' service, the buyer always has to notify us of these problems by sending us a mail. At our request, La Poste will initiate a 21 days investigation in its services. Usually during this time, La Poste finds the lost package and sends it to the addressee. If the package is not found within this time, we will send the same product again, or with your permission, a similar one. The shipping cost will then be on our expense.

We disclaim any responsibility for longer delivery times due to the carrier, particularly in cases of lost products or strikes.

7 - Merchandise return

We guarantee you complete satisfaction with our products. According to the ruling sales legislation for online sale, you have the possibility to send back any product to our address BIO PROVENCE S.A.R.L, 45 rue Fréderic Joliot Curie, BP 100, 13382 MARSEILLE Cedex 13 within the next 7 days of your package delivery and we will completely refund the amount you payed for the article by bank transfer or check.

 

This right does not apply to the products that are returned damaged, incomplete, without original packaging, or otherwise deteriorated by the client.

 

The shipping cost to return a product to BIO PROVENCE S.A.R.L are on the client's expense who has to make sure that the packaging is resistant enough to arrive in perfect state to BIO PROVENCE S.A.R.L location.

8 - Invoice Payment

Any customer placing an order is responsible for the order's invoice payment even if it is delivered to another address.

9 - Payment Mode

Credit card:

The payments are secured by a universally efficient system, this process ensures that through an SSL encryption with the Bank, the Card N° is only known to our bank La Banque Populaire. BIO PROVENCE S.A.R.L will not accept an order unless the payment bank centers have agreed to it. In case these centers refuse it, the client will be notified by email and his order will be automatically canceled.

Payment with bank checks or checks issued by a French bank:

In case of check payment, the Buyer will send his check written to the name of BIO PROVENCE. He will write the order's number on the back of the check and will send it to the following address:

Only the checks emitted by a French bank are accepted. BIO PROCENCE S.A.R.L. will send the corresponding order within the next 5 days after cashing the check, under reserve of solvency of the buyer.

10 - Litigation

In all cases of litigation, BIO PROVENCE S.A.R.L will make every effort to arrive to a friendly settlement.

 

The present contract is subject to the French law. In case of litigation, Marseilles' Tribunal of Commerce will be the exclusive jurisdiction. BIO PROVENCE S.A.R.L can not be held liable for damages of any kind, material and immaterial or corporal, that could result for a malfunction or improper use of the sold products.

 

BIO PROVENCE S.A.R.Ls' responsibility is limited, in any case, to the amount of the order and can not be blamed for simple errors or omissions that may occur despite all the precautions taken in the presentation of the products. In any case BIO PROVENCE S.A.R.L can not be held responsible for not respecting the regulations and laws applicable in the receiving country, its responsibility is always limited to the product's value, at the date of sale and with no possibility of appeal to the manufacturer brand of the product.

11 - Personal Information

BIO PROVENCE S.A.R.L is committed to not disclose confidential information transmitted by the buyers and the website visitors. The information will be used only for the processing of the order.

 

This section cannot prevent the sale or transfer of activity to a third party. According to the data protection act of the 6th January, 1978, the buyer has the right to access, make rectifications, and oppose to personal data.

 

To proceed with this right, the client has to send an e-mail or a mail notifying his e-mail, name, last name and address.

12 - Cookies

BIO PROVENCE S.A.R.L reserves the right to store cookies on your computer if you visit this website. A cookie does not allow us to identify you. It is a digital file stored on the visitor's hard disk. It reports the user's previous visit on the website. BIO PROVENCE S.A.R.L uses cookies in order to personalize the service offered to the user.

13 - Intellectual Property

All elements on the website www.boutique-pulpedevie.fr are BIO PROVENCE S.A.R.Ls' intellectual and exclusive property. No one is authorized to reproduce, use, repost, or use the software, visual or audio elements of this website for any purpose whatsoever, even partially.
